These Terms & Conditions (“Terms”) govern your access to and use of the A5 Autos website at a5autos.com, our mobile applications for iOS and Android (together, the “Platform”), and related services. By creating an account, browsing listings, posting a vehicle, or using any feature of the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. About A5 Autos

A5 Autos is an online marketplace that helps users discover vehicles for sale or rent, publish their own listings, save favorites, compare cars, and contact sellers. We also provide tools such as seller verification, a seller dashboard, the Process to Buy request flow, and Discuss Car AI (AI-assisted Q&A about listings in the app).

A5 Autos is not a car dealer, broker, insurer, or financing provider. Unless we state otherwise in writing, we are not a party to any agreement between buyers and sellers. Transactions, payments, inspections, registration, and delivery are arranged directly between users unless a separate written agreement with A5 Autos applies.

2. Eligibility and accounts

To use certain features (for example, posting listings, favorites, or Process to Buy), you must register for an account and provide accurate information. You agree to:

• Be at least 18 years old (or the age of majority in your jurisdiction, if higher)
• Keep your login credentials confidential and notify us of unauthorized use
• Maintain accurate profile and contact details
• Use only one account per person unless we approve otherwise

We may suspend or terminate accounts that violate these Terms, provide false information, or pose a risk to other users or the Platform. You may request account deletion as described on our Delete account page and in our Privacy Policy.

3. Listings and seller responsibilities

If you publish a listing for sale or rent on the web or app, you represent that you have the right to offer the vehicle and that your listing is truthful. You are solely responsible for:

• Accuracy of price, mileage, condition, specifications, photos, and location
• Compliance with applicable laws (including advertising, consumer, and vehicle registration rules)
• Responding to inquiries and negotiating with buyers or renters
• Updating or removing listings when a vehicle is sold, rented, or no longer available

We may review, approve, reject, pause, or remove listings at our discretion (for example, incomplete information, suspected fraud, or policy violations). Listing status values (such as draft, pending, active, sold, or rejected) are shown in your dashboard. Featured or urgent placement, if offered, may be subject to additional rules or fees communicated at the time of purchase.

4. Buyers and renters

When you browse or contact a seller through A5 Autos, you agree to:

• Verify vehicle details independently before paying or taking possession
• Use contact options (phone, email, WhatsApp where shown) lawfully and respectfully
• Understand that photos and descriptions are provided by sellers, not guaranteed by A5 Autos

The Process to Buy feature helps you submit legalization or transport-related requests for a specific listing. Submitting a request does not guarantee availability, pricing, or completion of any service; we or third parties may contact you using the details you provide.

5. Platform features

Search and browsing. You may search and filter cars for sale or rent on the website and in the app, view listing detail pages, and share links to listings. Shared links may open in the mobile app when installed.

Favorites and compare. Signed-in users may save favorites and compare listings. Data may be stored on our servers and associated with your account.

Seller verification. Individual and organization sellers may apply for verification badges. Verification reflects information we have reviewed at a point in time; it is not a guarantee of quality, legality, or future conduct.

Discuss Car AI. AI-generated answers about a listing are for general information only. They may be incomplete or inaccurate. Do not rely on them as professional, legal, mechanical, or financial advice. Always confirm details with the seller and qualified professionals.

Mobile app. Use of the A5 Autos app is subject to these Terms and to the applicable Apple App Store or Google Play terms. You are responsible for data charges and keeping your device secure.

6. Acceptable use

You must not:

• Post false, misleading, stolen, or infringing content
• Harass, spam, or scrape the Platform without permission
• Attempt to gain unauthorized access to accounts, systems, or data
• Use the Platform for illegal activity or to sell stolen vehicles
• Circumvent security, rate limits, or listing moderation
• Impersonate another person or misrepresent your affiliation with A5 Autos

7. Intellectual property

The Platform, including its design, logos, software, and text (excluding user-generated content), is owned by or licensed to A5 Autos and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Platform for personal or internal business use in connection with buying, selling, or renting vehicles through our services.

By uploading photos, descriptions, or other content to a listing, you grant A5 Autos a worldwide, royalty-free license to host, display, reproduce, and distribute that content on the Platform and in promotional materials related to our services. You retain ownership of your content and represent that you have the rights to grant this license.

8. Third-party services and links

The Platform may link to or integrate third-party services (for example, maps, analytics, advertising, authentication, or messaging apps such as WhatsApp). We do not control and are not responsible for third-party terms, privacy practices, or content. Your use of those services is at your own risk.

9. Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT LISTINGS OR USER CONTENT ARE ACCURATE, COMPLETE, OR LAWFUL.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A5 AUTOS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR VEHICLE VALUE, ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO A5 AUTOS FOR THE RELEVANT SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED EUROS (€100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

11. Indemnification

You agree to indemnify and hold harmless A5 Autos from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your listings or content, your interactions with other users, or your violation of these Terms or applicable law.

12. Changes to the Platform and Terms

We may modify features, pricing, or these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws applicable to A5 Autos’s place of operation, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless mandatory consumer protection laws in your country require otherwise.
